1. Introduction

Welcome to Sun Tixx. These Terms of Use govern your access to and use of the Sun Tixx website, event pages, hosted payment pages, payment links, ticketing services, checkout services, mobile or web-based ticketing tools, organiser tools, and any related services operated by or on behalf of Sun Tixx Caribbean Limited or its affiliates, trading as Sun Tixx.

By accessing, browsing, purchasing through, registering on, or otherwise using Sun Tixx, you agree to these Terms of Use. If you do not agree, you must not use the platform or purchase tickets, passes, products, experiences, or services through Sun Tixx.

These Terms apply to purchases made through:

  • www.suntixx.com;
  • Sun Tixx-hosted event landing pages;
  • independent campaign or event pages operated by Sun Tixx;
  • payment links issued by Sun Tixx or by organisers using Sun Tixx;
  • WooCommerce or other Sun Tixx checkout flows;
  • hosted payment pages powered by Sun Tixx;
  • event pages for festivals, concerts, tours, cultural events, conferences, and similar experiences, including but not limited to projects such as One Caribbean Music Festival, Calypso Fiesta, and other independent Sun Tixx ticketing or payment pages.

2. Role of Sun Tixx

Sun Tixx provides technology, ticketing, payment, access-control, reporting, and related event commerce services.

Unless expressly stated otherwise, Sun Tixx acts as a ticketing, payment facilitation, technology, and/or collection platform for event organisers, promoters, venues, merchants, tour operators, or other third-party sellers.

The event organiser, promoter, venue, merchant, or seller remains responsible for:

  • the event, product, tour, activity, or service being sold;
  • event staging, artist performance, venue access, safety, timing, and production;
  • compliance with permits, licences, venue rules, public health rules, and applicable law;
  • pricing, ticket categories, complimentary tickets, guest lists, and access rules;
  • refund policies, cancellation decisions, postponements, and event-specific terms;
  • customer service relating to the event experience, except where Sun Tixx expressly agrees to provide support.

Sun Tixx is not the organiser, promoter, performer, venue operator, travel provider, security provider, or producer of an event unless Sun Tixx is expressly identified as such.

3. Payment Processing and Gateway Disclosure

Sun Tixx may process payments using one or more payment processors, acquiring banks, gateways, or payment technology partners, including but not limited to:

  • Stripe;
  • Scotiabank / Scotia eCom+ / Fiserv / First Data-related processing services;
  • other approved acquiring banks, payment gateways, card processors, fraud-prevention providers, or settlement partners.

Depending on the type of card, currency, location, merchant setup, event, risk controls, technical availability, fraud screening, or processing rules, a transaction may be routed through Stripe, Scotiabank, Scotia eCom+, Fiserv, or another approved payment processor.

By making a purchase, you authorise Sun Tixx, the relevant event organiser or merchant, and their payment processors to charge your selected payment method for the amount shown at checkout, including applicable ticket price, service fees, processing fees, taxes, delivery fees, add-ons, or other disclosed charges.

4. Card Statement Descriptor

Customers are hereby advised that charges may appear on their bank, card, or account statement under one or more descriptors, including:

  • Sun Tixx;
  • SunTixx;
  • Sun Tixx Caribbean Limited;
  • the name of the event, organiser, venue, or merchant;
  • a shortened or processor-specific version of any of the above.

Where Sun Tixx processes payments on behalf of an organiser, merchant, or client, the customer acknowledges that Sun Tixx may appear as the payment processor or merchant descriptor on the card or bank statement, even where the purchase relates to a third-party event, tour, product, or service.

This disclosure is intended to reduce confusion, mistaken disputes, and chargebacks.

5. Ticket Purchases and Order Confirmation

A ticket, pass, booking, payment link purchase, or order is not confirmed until payment has been successfully authorised, captured, and confirmed by Sun Tixx or its payment processor.

After successful payment, the customer may receive one or more of the following:

  • an order confirmation;
  • an electronic ticket;
  • a QR code, barcode, or access credential;
  • a receipt;
  • an invoice;
  • a payment confirmation email;
  • event-specific instructions.

Customers are responsible for ensuring that the email address, phone number, name, and other details provided at checkout are accurate.

Sun Tixx is not responsible for lost confirmations, undelivered emails, spam filtering, incorrect customer information, or failure by the customer to check order details.

6. Ticket Delivery, Access, and Entry

Tickets may be delivered electronically, by email, by download, by account login, by mobile display, by print-at-home PDF, by box office collection, by organiser-issued wristband, or by another method stated at purchase.

Possession of a ticket does not guarantee entry where:

  • the ticket has already been scanned or redeemed;
  • the ticket has been cancelled, refunded, voided, reversed, or flagged for suspected fraud;
  • the ticket was obtained through unauthorised resale or duplication;
  • the customer fails to meet age, identification, dress code, security, health, venue, or event-specific requirements;
  • the venue, organiser, police, security, or lawful authority refuses entry for safety, legal, operational, or behavioural reasons.

Sun Tixx may assist with ticket validation and access control but is not responsible for venue security decisions unless Sun Tixx directly controls the event entry operation.

7. Event Changes, Postponements, and Cancellations

Event dates, times, venues, artists, speakers, performers, attractions, schedules, seating arrangements, and programme details may change.

Unless otherwise required by law or expressly stated in an event-specific policy:

  • the organiser is responsible for decisions on cancellation, postponement, relocation, rescheduling, substitution, or material event changes;
  • Sun Tixx may communicate updates on behalf of the organiser;
  • Sun Tixx is not liable for travel, accommodation, transportation, parking, meals, lost time, lost opportunity, or other incidental costs arising from event changes.

Where an event is postponed or rescheduled, tickets may remain valid for the new date unless the organiser states otherwise.

8. Refunds, Voids, Reversals, and Cancellations

All sales are subject to the refund policy displayed for the relevant event, product, service, organiser, or merchant.

Unless expressly stated otherwise, service fees, processing fees, delivery fees, platform fees, and administrative fees may be non-refundable.

Refunds may be issued by:

  • Sun Tixx;
  • the event organiser;
  • the merchant;
  • the acquiring bank;
  • the payment processor;
  • another authorised party.

Refund timing may vary based on the processor, bank, card network, customer’s issuing bank, currency, settlement status, fraud review, and whether the transaction has already been captured or settled.

A void or reversal may be available only where the transaction has not yet been fully settled. Once settled, a refund may be required instead of a void.

Sun Tixx reserves the right to refuse or delay a refund where:

  • the organiser has not authorised the refund;
  • the transaction is under fraud review;
  • the payment has been disputed or charged back;
  • the ticket has been used, scanned, redeemed, or partially consumed;
  • the customer has breached these Terms;
  • the request is inconsistent with the event-specific refund policy.

9. Chargebacks and Payment Disputes

Customers should contact Sun Tixx or the event organiser first if they do not recognise a charge, require assistance, or believe there is an issue with a purchase.

Where a customer files a chargeback or payment dispute in relation to a valid transaction, Sun Tixx may provide relevant transaction records, ticket records, delivery logs, scan logs, IP/device information, customer communications, event attendance records, invoice records, refund records, and other evidence to the bank, card network, processor, organiser, or merchant.

Sun Tixx reserves the right to:

  • suspend ticket access while a dispute is pending;
  • cancel tickets connected to a disputed payment;
  • restrict future purchases;
  • recover chargeback fees, administrative costs, or losses where permitted by law;
  • decline future transactions from customers with excessive disputes, suspected abuse, or fraudulent activity.

10. Fraud Prevention and Transaction Monitoring

Sun Tixx may monitor transactions for fraud, abuse, duplicate purchases, unusual order patterns, stolen cards, suspicious IP addresses, bot activity, unauthorised resale, account takeover, or other risk signals.

Sun Tixx may request additional verification before confirming or fulfilling an order.

Sun Tixx may cancel, hold, refuse, refund, void, or reverse any transaction that it reasonably believes is fraudulent, unauthorised, suspicious, unlawful, high-risk, technically erroneous, or in breach of these Terms.

11. Independent Landing Pages and Client Campaign Pages

Sun Tixx may create or support independent event landing pages, campaign pages, branded checkout pages, microsites, or payment pages for specific events, festivals, promoters, venues, merchants, or projects.

These pages may include the branding of the organiser, merchant, sponsor, festival, venue, or event, but the underlying ticketing or payment processing may still be operated, supported, or facilitated by Sun Tixx.

Customers purchasing through such pages are bound by:

  • these Sun Tixx Terms of Use;
  • the Sun Tixx Privacy Policy;
  • any event-specific terms displayed on the page;
  • any organiser-specific, venue-specific, refund-specific, or access-specific terms;
  • applicable payment processor terms.

Where there is a conflict, the event-specific terms will apply to the event experience, while these Terms will apply to platform use, ticketing, payment processing, fraud prevention, data handling, disputes, and Sun Tixx services.

12. Pricing, Fees, Taxes, and Currency

Prices may include or exclude service fees, processing fees, platform fees, organiser fees, taxes, or other charges depending on the event or checkout flow.

The total amount payable will be displayed before payment is submitted.

Transactions may be processed in Trinidad and Tobago dollars, United States dollars, or another supported currency depending on the event, merchant account, gateway, card type, processor, or settlement configuration.

Currency conversion, foreign exchange fees, international card fees, cash advance treatment, or bank charges imposed by the customer’s card issuer or bank are the customer’s responsibility.

13. Promo Codes, Complimentary Tickets, Guest Lists, and Manual Orders

Sun Tixx may support promo codes, discounted tickets, complimentary tickets, sponsor tickets, guest lists, manual orders, box office sales, cash sales, POS sales, invoice payments, and payment links.

Such tickets remain subject to validation, event access rules, capacity limits, fraud controls, and organiser approval.

Sun Tixx may cancel or invalidate complimentary, discounted, or manually issued tickets where they were issued in error, duplicated, misused, transferred contrary to event rules, or obtained through unauthorised means.

14. Ticket Resale and Transfer

Tickets may not be resold, transferred, duplicated, commercially exploited, or offered for promotional use unless expressly permitted by the organiser and Sun Tixx.

Sun Tixx may cancel tickets that appear to have been resold through unauthorised channels, sold above face value, duplicated, counterfeited, or transferred in breach of event rules.

15. User Accounts

Some Sun Tixx services may require users, organisers, merchants, staff, or administrators to create an account.

Users are responsible for maintaining the confidentiality of login details and for all activity under their account.

Sun Tixx may suspend or terminate an account where it reasonably suspects unauthorised access, fraud, misuse, violation of these Terms, excessive disputes, security risk, or unlawful conduct.

16. Organiser and Merchant Responsibilities

Organisers and merchants using Sun Tixx are responsible for:

  • providing accurate event, product, pricing, venue, capacity, seating, and refund information;
  • honouring valid tickets and confirmed purchases;
  • complying with applicable laws, licences, tax obligations, consumer protection obligations, and venue rules;
  • ensuring event safety, production, staffing, security, and delivery;
  • responding promptly to customer issues;
  • funding refunds, where applicable;
  • maintaining accurate settlement, reconciliation, and reporting information;
  • not using Sun Tixx for unlawful, misleading, restricted, or prohibited activities.

Sun Tixx may require organisers or merchants to provide business verification, banking information, identity information, event documentation, tax information, proof of authority, venue confirmation, or other due diligence materials.

17. Prohibited Activities

You must not:

  • use Sun Tixx for fraud, money laundering, terrorist financing, unlawful gambling, prohibited goods, scams, or illegal activity;
  • use stolen, unauthorised, or fraudulent payment methods;
  • attempt to bypass payment, access control, ticket validation, seating controls, limits, or security measures;
  • scrape, copy, attack, reverse engineer, overload, interfere with, or compromise the platform;
  • upload malware, malicious code, false information, or misleading content;
  • impersonate another person or business;
  • submit false chargebacks or abusive refund claims;
  • duplicate, counterfeit, alter, or resell tickets without authorisation;
  • use bots or automated purchasing tools without written permission;
  • interfere with another user’s access to the platform or event.

18. Platform Availability

Sun Tixx aims to provide reliable service but does not guarantee uninterrupted, error-free, or fully available operation.

Service may be affected by maintenance, upgrades, hosting issues, internet outages, payment gateway downtime, bank downtime, third-party processor issues, force majeure events, cyber incidents, or circumstances beyond Sun Tixx’s control.

Sun Tixx is not liable for temporary unavailability of payment gateways, bank systems, email providers, SMS providers, hosting providers, or other third-party services.

19. Intellectual Property

All Sun Tixx trademarks, logos, software, systems, page designs, content, graphics, documentation, workflows, source code, checkout flows, reports, interfaces, and platform materials are owned by Sun Tixx or its licensors.

Users, organisers, or merchants may not copy, reproduce, modify, distribute, reverse engineer, resell, or exploit Sun Tixx intellectual property without written permission.

Event organisers and merchants are responsible for ensuring that any content, logos, images, videos, sponsor marks, artist names, venue materials, or promotional materials they provide are properly authorised.

20. Third-Party Services

Sun Tixx may integrate with third-party services, including payment processors, banks, card networks, email providers, SMS providers, analytics tools, fraud-prevention tools, hosting providers, ticket scanning tools, accounting tools, and other technology vendors.

Use of third-party services may be subject to those third parties’ own terms, privacy notices, and processing rules.

Sun Tixx is not responsible for third-party systems except to the extent required by applicable law or a written agreement.

21. Data, Privacy, and Communications

Use of Sun Tixx is also governed by the Sun Tixx Privacy Policy.

By using Sun Tixx, you agree that Sun Tixx may send transactional communications related to your purchase, ticket, payment, refund, dispute, account, event, or security issue.

These may include emails, SMS messages, WhatsApp messages, system notices, receipts, invoices, ticket confirmations, refund notices, event updates, dispute notices, or support messages.

Marketing communications will be handled in accordance with applicable law and your communication preferences.

22. Limitation of Liability

To the fullest extent permitted by law, Sun Tixx will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, loss of revenue, loss of data, loss of goodwill, travel costs, accommodation costs, wasted expenditure, business interruption, or personal disappointment arising from use of the platform or attendance/non-attendance at an event.

Where liability cannot be excluded, Sun Tixx’s maximum liability will be limited to the amount of fees actually received by Sun Tixx in connection with the specific transaction giving rise to the claim, excluding amounts collected on behalf of organisers, merchants, venues, or third parties.

Nothing in these Terms excludes liability that cannot be excluded under applicable law.

23. Indemnity

You agree to indemnify and hold harmless Sun Tixx, its directors, officers, employees, contractors, affiliates, processors, service providers, and agents from any claims, losses, damages, liabilities, penalties, costs, or expenses arising from:

  • your breach of these Terms;
  • your misuse of the platform;
  • your violation of law;
  • your fraudulent or unauthorised activity;
  • your infringement of third-party rights;
  • your event, product, service, content, or customer dispute, where you are an organiser or merchant.

24. Force Majeure

Sun Tixx will not be liable for delay, failure, loss, interruption, cancellation, or disruption caused by events beyond its reasonable control, including natural disasters, extreme weather, fire, flood, pandemic, epidemic, strike, labour disruption, utility failure, internet failure, cyberattack, war, civil unrest, government action, police action, venue closure, artist non-performance, supplier failure, bank downtime, payment gateway downtime, or card network disruption.

25. Changes to These Terms

Sun Tixx may update these Terms from time to time.

The updated Terms will be posted on the Sun Tixx website with a revised “Last Updated” date.

Continued use of Sun Tixx after updates means that you accept the revised Terms.

26. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of Trinidad and Tobago.

Unless otherwise required by law, disputes shall be subject to the courts of Trinidad and Tobago.
